Personal Data Protection Act 2010 (“PDPA”)
1.0 General
1.1 ZICO Trust (M) Berhad (“ZTMB”) and its subsidiaries are dedicated to preserving your privacy in compliance with Malaysia’s Personal Data Protection Act 2010 (“PDPA”). This Policy describes:

the types of personal data that ZTMB collects and the methods used to derive it;

how ZTMB uses your personal information;

the parties to whom ZTMB discloses the personal information; and

your data protection rights, including how to access and update your personal information.
1.2 “Personal information” refers to any information that directly or indirectly relates to you and has been or will be provided by you to ZTMB, including but not limited to your name, National Registration Identity Card number, corresponding address, telephone number, email address, images, your personal preferences, particulars of any third party or Beneficiary(ies), financial and banking account information, and any information that may identify you that has been or may be collected, stored, used, and processed by ZTMB from time to time. The term “personal information” also includes sensitive personal information, which means any personal information consisting of information as to physical or mental health or condition, political opinions, religious beliefs, or other beliefs of a similar nature, or the commission and/or alleged commission of any offence.
1.3 Failure to provide your personal data to ZTMB as stipulated in any of its deeds, agreements, forms, applications, or otherwise required by ZTMB, whether through manual or electronic means, may result in ZTMB being unable to establish, continue or provide the trust services and/or other services provided by ZTMB or comply with any laws or guidelines issued by regulatory bodies or other authorities.
1.4 For general online browsing, ZTMB will only collect your personal information, such as your name and contact details. If you provide ZTMB with any personal information related to a third party, you indicate to ZTMB that you have obtained the necessary third-party consent to provide ZTMB with their personal information, for the purposes below.
2. Collection of Personal Data
2.1 ZTMB may collect personal information from you, its Authorised Agent(s), other party(ies), or publicly available source(s), including but not limited to:

when you sign up for ZTMB product(s) and service(s), and become a customer/client of ZTMB;

when you submit any form(s), such as application and/or claim forms;

when you contact ZTMB for any inquiry(ies), complaint(s), comment(s), or feedback(s), whether in person, over the counter, by email, by phone, or through any other electronic means;

when you initiate a business association with ZTMB;

when you visit any of ZTMB premises;

when you apply for a position within the ZTMB organisation;

while you visit or navigate the ZTMB website;

when you participate in any of the ZTMB corporate event(s) or training session(s);

when ZTMB acquires information about you or receives references from business partner(s) and third party(ies) with whom ZTMB has engaged or is affiliated, such as agent(s), credit reporting agency(ies), and/or any financial institution(s).
3. Use of Personal Data
3.1 Your personal information may be used, recorded, stored, archived, disclosed or otherwise processed by and/or on behalf of ZTMB, including but not limited to the following purposes as stated below:

to conduct trust businesses, including but not limited to carrying out any activities or duties as a Trustee, for operational or internal management purposes, as may be applicable;

to conduct assessments for anti-money laundering and other compliance purposes in adherence to regulatory standards and protocols;

to assess or process any deeds, agreements or applications submitted on any of ZTMB’s products and services;

to improve and develop ZTMB’s products and services;

to respond to your enquiries and complaints;

to manage and enhance the provision of trust deeds and/or other services provided by ZTMB to its customers/clients;

to match and update any personal information held by ZTMB relating to you from time to time;

to facilitate and process any modifications, variations, terminations, or renewals of ZTMB’s products or services;

for any legal proceedings or potential litigation, if applicable;

if required by law or in good faith, to comply with any law enforcement, court orders or legal process, and/or to protect and defend the rights or property of ZTMB; and
-
any activity related or incidental to any abovementioned purposes.
4. Disclosure of Personal Data
4.1 In the course of the providing, managing and/or operating ZTMB product(s) and service(s) to you, ZTMB may provide or disclose your personal information, to the extent necessary, to the following parties for the purposes set out in Clause 3, subject at all times to any applicable laws or practice, guidelines, obligations and/or directives from any regulatory authorities:

any officer, employee, or director of ZTMB or its subsidiaries;

any companies and/or organisations that act as agents, service providers and/or professional advisers to ZTMB (if applicable);

any person authorised to act as an agent of ZTMB or its subsidiaries in relation to the distribution of products and services offered by ZTMB or its subsidiaries (if applicable);

third party credit reference and/or reporting agencies registered under the Credit Reporting Agencies Act 2010, any authority including Bank Negara Malaysia, any other governmental or regulatory authority or body, and any insolvency department;

any agent or third-party service provider, within or outside ZTMB, who provides and assists ZTMB in processing and/or otherwise fulfilling transactions that you have requested; and
-
any authorised third party ZTMB believes in good faith to be tendering payment on your behalf.
5. Protection of Personal Data
5.1 ZTMB ensures that your personal information is highly secured and greatly valued as much as ZTMB’s assets. ZTMB regularly reviews and implements up-to-date technical and organisational security measures when processing your personal information.
5.2 ZTMB’s employees are well-trained to handle your personal information securely and with strict confidentiality. Failure to do so may result in disciplinary action.
5.3 ZTMB’s website may link to other websites and ZTMB is not responsible for its data policies, procedures or content.
6. Access Rights to Personal Data
6.1 You may access certain personal information held by ZTMB under the applicable data protection laws of Malaysia. Should you desire to access your personal data or believe that such personal information kept by ZTMB is inaccurate, incomplete, misleading, or out of date, you may, at your discretion, request via email at info@zicotrust.com.my along with the relevant supporting documentation.
6.2 ZTMB reserves the right to charge costs which are directly related to and necessary for the processing of any request for personal data.
7. Retention of Personal Data
ZTMB retains your personal information to the extent where its legal or business purposes for acquisition or use remain applicable, until the information has fulfilled its intended purpose, or unless otherwise compelled by law, mandated by government authority, or required for legal proceedings.
8. Consent
8.1 By submitting your personal information, you agree to the use of such information as described in this Policy. ZTMB may review and update this Policy from time to time to reflect changes in the law, business practices, procedures, and structure of ZTMB. By continuing to use the service, you indicate your acceptance of any such modifications.
8.2 ZTMB will take reasonable and best efforts to safeguard your personal data within its possession and control by implementing reasonable security measures to mitigate the risks of unauthorised access, collection, use, disclosure, copying, modification, disposal or similar threats. Despite these measures, ZTMB does not guarantee the absolute security of any personal data that may have collected from or about you. ZTMB holds no liability for any damages resulting from any personal data breaches, on unauthorised and/or fraudulent use of your personal data.
